ELLSWORTH, Maine - The joint trial of a Lamoine man and his wife accused of robbing his 74-year-old grandmother of a safe containing $40,000 started Monday in Hancock County Superior Court.

Steven W. Robbins, 39, and Juanita S. Mullins, 36, are each charged with robbery, burglary, two counts of theft, assault, kidnapping and obstructing the report of a crime in the incident that occurred on Jan. 22, 2005.

Monday’s witnesses included the victim’s grandson, Bobby Merchant of Lamoine, and Hancock County Sheriff’s Deputy Jeff McFarland, who responded to the incident report. McFarland will continue on the stand today.

Merchant testified that intruders broke into the elderly woman’s home on Buttermilk Road in Lamoine, handcuffed her to a bed, bound her legs with a telephone cord and put a pillowcase over her head while they looked for the safe. The safe was then taken from the premises.

The victim, after freeing her legs, alerted neighbors by flashing an outdoor light and yelling across the road.

She was never able to positively identify her attackers.

According to Merchant, the estimated $40,000 was from his business, Haslam’s Septic Service in Lamoine, of which the victim is a part owner. He said the money was used for business purposes and that the company has used the safe since 1979.

Attorneys Theodore Fletcher and Steven Juskewitch are representing Robbins and Mullins respectively.

"We aren’t questioning what happened, we are questioning who did it," said Fletcher, after the day’s testimony.

District Attorney Carletta Bassano is prosecuting the case, which is expected to last through the week.

More than 700 pages of discovery evidence and a jury ruling in May have delayed the 2½-year-old case from being heard until now.
